Key Issue 1 – Contracts
1. What steps should be taken to review, negotiate and resolve all rejected and amended terms proposed by the preferred candidate supplier. Including configuration control of all documents associated with the negotiation process.
2. Identify any contractual risks if your Project Team were to accept those changes as presented. Provide examples where such risks can and cannot be accepted.
3. Identify and provide examples where alternative negotiation strategies can and have been used to resolve issues related to preferred terms and conditions of contract.
4. Discuss the schedule impact associated with prolonged negotiations.
Key Issue 2 Project Budgets for procurement process
1. Discuss the benefits of a cost neutral approach to project and procurement costs.
2. What are the risks to the Project Team and Supplier if a Milestone Payment Schedule is not balanced? Provide recent good and bad examples from any industry that can be applied to this case study.
3. Identify Milestone Payment Schedule Templates that are commonly used across various industry backgrounds and discuss why they may differ from industry to industry.
Provide examples that support those approaches.
Task:
You are required to present a report to be issued to your Program Manager, that address the two key areas listed above. This report will address the four key issues associated with Contracts to provide a strategy and process steps to allow the Program Manager to consider and accept that the terms of contract are mutually agreed by both parties.
You are then required to prepare a Milestone Payment Schedule that has also been mutually agreed, but also provides detailed background information that demonstrates that the Project Team has considered all aspects of the proposal offered by the preferred candidate supplier, such that any risks and cost neutrality has been achieved. It is expected that no less than eight references will be used to support the findings of the report.
