3.5 Business Ethics The National Enquirer, Inc., is a Florida corporation with its principal place of business in Florida. It publishes the National Enquirer, a national weekly newspaper with a total circulation of more than 5 million copies. About 600,000 copies, almost twice the level in the next highest state, are sold in California. The National Enquirer published an article about Shirley Jones, an entertainer. Jones, a California resident, filed a lawsuit in California state court against the National Enquirer and its president, who was a resident of Florida. The California lawsuit sought damages for alleged defamation, invasion of privacy, and intentional infliction of emotional distress. Calder v. Jones, 465 U.S. 783, 104 S.Ct. 1482, 79 L.Ed.2d 804, Web 1984 U.S. Lexis 4 (Supreme Court of the United States) Based on the information above (not going into details of the actual case) answer the following questions: 1. What kind of paper is the National Enquirer? 2. Was it ethical for the National Enquirer to try to avoid suit in California? When answering question 2, I expect to find a discussion which includes reason why, why not and which of the two you favor and what tipped the scale one direction or the other. 3. Are the defendants subject to suit in California? Why or why not? When answering question 3, I expect to find a discussion which will include subject matter and personal jurisdiction, long arm statute, significant contact, and other relevant considerations, for both the state and federal court and your conclusions of whether the defendants are subject to suits in either court or both. Your discussion of question 3, should also include a summary of what law would be applied, ie. state, federal, common law. etc. For example if I was answering question three I would start by explaining that for a person to be subject to a suit in a court the court must have subject matter jurisdiction to hear that type of claim and personal jurisdiction over the defendant and go on to give a more detailed information about both and how it applied to the defendant.
