What are your thoughts regarding caps on malpractice awards? California currently has a $250,000 cap for non-economic damages in medical malpractice lawsuits. Caps were first put in place in California in 1975, and many states followed suit with caps; however, the tables have turned, and now California ranks at the low end of the 35 states with caps (Lazo, 2014). In fact, California recently voted down a proposal to raise medical malpractice caps (Laso, 2014). Removing or increasing caps will likely increase medical malpractice insurance costs; therefore, passing these costs on to the patient.
