The Magna Carta was signed in England by the king in 1215. While it was essentially signed to prevent abuse of power by the monarch by ensuring the monarch subject to the law, it also paved the way for further reforms that led to the establishment of the two houses of parliament. Essentially, this means that the signing of the Magna Carta was a catalyst in establishing democracy in England. Several centuries after the signing of the Magna Carta, it was decided that English law applied in Australia on the basis that New South Wales was a settled colony. The British parliament also introduced an Act in 1865 that would void any legislation that may be introduced in the colonies if they were at odds with British Law. Therefore, given that the Magna Carta helped shape British law – upon which the Australian legal system took its form – the Magna Carta has most definitely affected Australian law.
W2 In simple language what is the difference between the Senate and the House of Representatives.
The Senate and the House of Representative have several deliberate differences, as would be expected of any efficient bicameral parliament system. The number of representatives in the House of Representatives in each state or territory are proportional to the population of that state. Moreover, the members in the House of Representatives represent a geographic area, which are known as electorates, districts, or seats. These electorates correlate with the population spread. Somewhat conversely, The Senate represents all states and territories equally. This means that there are an equal number of representatives elected in each state/territory, regardless of population. Take the states of Victoria and Tasmania as an example. In Victoria there are currently 38 electoral districts for the Australian House of Representatives, whereas in Tasmania there are only 5. Meanwhile, both states have 12 elected Senators. This gives Tasmania an equal voice in the Senate, despite having a much smaller population.
